1. Terms

2. Use License

Attempt to decompile or reverse engineer any software contained on XDotscript's web site. 2. Remove any copyright or other proprietary notations from the materials (unless you bought the rights). 3. Transfer the materials to another person or "mirror" the materials on any other server. 4. Resell the software, software license or single licenses within you license pack. Your license shall automatically terminate if you violate any of these restrictions and may be terminated by XDotscript at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format. By purchasing the Titan you automatically state that you agree to XDotscript Refund Policy. The only person eligible for the software support is the software licensor (the person who bought the license/software). In case of any suspicious activity, XDotscript reserves the right to terminate the license or require the licensor to use his payment email address for support contact. Titan Admin Panel is hosed on secure XDotscript servers. XDotscript guarantees 99% server uptime and full HTTPS connection from/to the admin panel server. XDotscript also guarantees that it will never access any of you data, attempt any unauthorized connection to your database and will not interfere with your data in any other way. Your data is not being kept nor cached on our server, and it's accessed via secure DB API queries only.

3. Termination of the agreement

Any type of dispute or chargeback will result in a permanent license suspension. In case of any Terms Of Service violation, XDotscript may suspend the customer license and terminate the coding agreement. XDotscript may also terminate the agreement if the customer threatens/blackmail/make false accusations against XDotscript or its employees. No refund is applicable in those cases.

4. Disclaimer

The materials on XDotscript's web site are provided "as is". XDotscript makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, XDotscript does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

5. Limitations

In no event shall XDotscript or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on XDotscript's Internet site, even if XDotscript or a XDotscript authorized representative has been notified orally or in writing of the possibility of such damage. The Services provided by XDotscript may only be used for lawful purposes. You agree to comply with all applicable laws, rules and regulations in connection with your use of the Services. XDotscript reserves the right to refuse service to anyone. Any material that in our judgment violates this AUP in any manner may be removed from our servers (or otherwise disabled), with or without notice. Failure to respond to an email from our abuse department within the specified time period in our email to you may result in the suspension or termination of the Services.

Overview
The DMCA limits web host’s liability for vicarious and contributory copyright infringement when their users infringe a third party’s copyright. The penalties for knowingly engaging in vicarious copyright infringement can be up to three times the damages caused by the infringement. However, if a web host follows the procedures set out in the DMCA, they are not liable for their customer’s copyright infringement. This is referred to as “Safe Harbor.” Web hosts are also not responsible for actions they take based on notifications they receive that are in compliance with the DMCA. Accordingly, it is in HOSTING’s business interests to follow the procedures of the DMCA.
The Process
Web hosts, entities providing notice of copyright infringement, and the targets of those notices are required to meet very strict criteria set out in the DMCA. These criteria are not negotiable, and cannot be varied by the participants in the process. What this means is that HOSTING cannot take into account any traditional defenses to copyright infringement like “fair use” or “public domain.” Nor can HOSTING vary the criteria required of DMCA notices or responses. While HOSTING values reasons why it should vary its procedures, the DMCA does not provide HOSTING the flexibility to do so.
Our Position
HOSTING recognizes that the DMCA is an imperfect law, and frequently receives comments pointing out how the DMCA may have been used for purposes possibly not intended by Congress. To the extent possible given its corporate and legal obligations, HOSTING attempts to mitigate these uses for its customers. The fact is, however, that the DMCA provides very little room for HOSTING to take these actions. For this reason, HOSTING encourages those who feel that the DMCA has been used for inappropriate purposes to contact their legislators and let them know how their business has been affected.
